How Do You Evict a Tenant in Texas?

In Texas, a landlord must follow specific procedures to evict a tenant. Here is a general overview of the process:

  1. The landlord must give the tenant written notice that the lease will be terminated. The notice period depends on the reason for the eviction and the type of lease.
  2. If the tenant does not vacate the property after the notice period, the landlord may file an eviction lawsuit in justice court.
  3. The court will schedule a hearing, and both the landlord and tenant will have the opportunity to present their case.
  4. If the court rules in favor of the landlord, the tenant will be ordered to vacate the property.
  5. If the tenant does not vacate the property, the landlord may ask the court to issue a writ of possession, which authorizes the sheriff to remove the tenant and their belongings from the property.
